First question: who has the authority to sell?

Before an inherited house can be sold, the title company needs to see that the seller has legal authority. In Texas that usually runs through the probate court in the county where the owner lived. For Killeen and Harker Heights that's Bell County, and for Copperas Cove it's usually Coryell County.

Common routes include:

  • Will probated as a muniment of title. A faster, simpler Texas option in some cases, generally when the estate has no unpaid debts other than those secured by real estate.
  • Independent administration. The court appoints an executor, who can then sign to sell the property.
  • No will. The heirs may be able to use an affidavit of heirship or may need a court-supervised administration. Title companies differ on what they'll insure.

This is general information, not legal advice. A Texas probate attorney can tell you which route fits your situation. We're happy to make an offer while probate is in progress and close once the title company is satisfied.

We make the hard parts easier

  • Belongings: take what matters to the family and leave the rest. We handle the clean-out.
  • Multiple heirs: every owner signs, but they can sign from different states. Everyone gets the same written offer and numbers.
  • Carrying costs: property taxes, insurance and utilities keep coming while a house sits empty. A quick sale stops that.
  • Liens and back taxes: these can usually be paid out of the proceeds at closing.
  • Condition: deferred maintenance, outdated everything, or a house that's sat vacant for a year. We buy it as it is.

Keep, rent, list or sell for cash?

If the house is in good shape and the family agrees, renting it or listing it with an agent can make sense. If it needs a lot of work, the heirs are spread out, or nobody wants to manage it, a cash sale is often the cleanest way to settle the estate and split the proceeds.

Questions

Straight answers.

Can we sign a contract before probate is finished?

Often, yes. The closing itself happens once the title company confirms the seller has authority and can insure the title.

What if the heirs don't agree on selling?

All owners have to sign. A written offer with the numbers laid out often helps families make a decision together, and we'll answer anyone's questions.

Do we have to clean out the house?

No. Take anything you want to keep and leave the rest.

Are there taxes on selling an inherited home?

Inherited property often gets a stepped-up cost basis, which can reduce capital gains tax on a quick sale. Check with a CPA for your situation.
